On 8th July 2024, the Supreme Court of India commenced hearings concerning the NEET UG 2024 Exam. A bench consisting of Chief Justice DY Chandrachud, Justices J B Pardiwala, and Manoj Misra reviewed a total of 38 petitions.

However, the Central government and the National Testing Agency (NTA), which conducts NEET-UG, told the Supreme Court that canceling the exam would harm many honest students, as there is no proof of a major confidentiality breach.

According to Supreme Court Decision on NEET UG 2024, the next hearing is scheduled for 11th July 2024. “The fact that sanctity of exam has been compromised is beyond doubt. It is an admitted fact that there is a leak and the nature of leak is something that we are determining. If it is not extensive then there is no cancellation. But before we order a retest, we must be conscious of extent of leak as we are dealing with 23 lakh students. This concerns cost to be incurred like travelling, dislodging academic schedule etc. So what is the nature of leak, how was the leak, the time, how was the leak disseminated, what are the actions which centre and NTA has done to identify the beneficiary students of the wrongdoing," the CJI remarked.
The Court also said that if the leak was on social media, then it would have been very widespread.

Hence, it set out the following parameters on the basis of which it would decide whether a retest would be needed or not.

  • one, whether the alleged breach took place at the systemic level;
  • two, whether the breach is of a nature which affects integrity of the entire exam process; and
  • three, whether it is possible to segregate the beneficiaries of the fraud from the untainted students.”
